1. NO PURCHASE NECESSARY TO ENTER OR WIN.
2. ELIGIBILITY: Open to Hong Kong and non-Hong Kong residents, entrants must be 18 years of age and older as of 13 March 2023 HKT, except for employees of Rosewood Hong Kong ("Sponsor"), bmf ("Administrator"), and members of their immediate family or persons living in the same household. Void where prohibited.
3. HOW TO ENTER: Giveaway begins and is announced on 13 March 2023 at 6pm HKT; closes on 21 March 2023 at 11:59pm HKT. To participate and enter this Giveaway, individuals will need to follow Rosewood Hong Kong’s Instagram Account “@rosewoodhongkong”. To enter the contest via Instagram, during the Entry Period (see above), follow the call-to-action provided in the Giveaway Instagram post on how to enter. The call-to-action for this Giveaway will require entrants to: (i) “Follow” Sponsor’s Instagram Account, (ii) “tag” THREE (3) friends on Instagram in the comment of the Giveaway post sharing what their favourite art piece is, (iii) entrants must also share Sponsor’s Giveaway Announcement Post to their Instagram Story using the campaign hashtag #RosewoodArtistryHK, and (iv) send the screen cap of their reposted story to @rosewoodhongkong via DM. Sponsor may not receive entries that fail to strictly follow the posting instructions set forth in these Official Rules and Sponsor is not responsible for failure to see or receive an entry.
Multiple entries will be accepted during the Entry Period. Entries containing false contact information or otherwise may be disqualified. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified. Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Contest, at Sponsor’s sole and absolute discretion. Illegible and/or incomplete entries and entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Those who do not follow all of the instructions or abide by these Official Rules or other instructions of Sponsor may be disqualified. Sponsor may not receive entries that fail to strictly follow the posting instructions set forth in these Official Rules and Sponsor is not responsible for failure to see or receive an entry. Contest Entities are not responsible for any changes or unavailability of the Instagram service that may interfere with the Contest (including any limitations, any restrictions, or any conditions on Sponsor’s ability to use such services for the Contest as set forth herein that are not acceptable to Sponsor) or ability of entrant to timely enter, receive notices or communicate with Sponsor via Instagram, in which case Sponsor, in its sole discretion, may terminate or modify the Contest. In the event of a dispute concerning who submitted an entry, the entry will be declared to have been made by the registered account holder of the email address associated with the account for the potentially winning entrant, but only if that person meets all other eligibility criteria or if that person is the approving parent or legal guardian of a minor participant who meets all of the eligibility criteria. A registered “account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Potential winners may be required to provide Sponsor with proof that he/she is the registered account holder for the email address associated with the account for the potentially winning entry. If a dispute cannot be resolved to Sponsor’s satisfaction, the entry will be deemed ineligible. Any damage made to any website or the Instagram service will be the responsibility of the registered account holder of the email address for the account submitted at the time of entry. Sponsor may run multiple campaigns, contests, sweepstakes or other promotions simultaneously. Entry into one (1) campaign, contest or sweepstakes does not constitute entry into any other.
4. WINNER SELECTION: This giveaway will close on 15 January 2023 at 11:59pm HKT. Sponsor will select the THREE (3) winners according to the judging criteria listed on the giveaway post from among all eligible entries received. The final winners will be notified by Instagram Direct Message (“DM”) on 31 January 2023 and must reply to @rosewoodhongkong within 2 days of the date notice is sent or such other date set by Sponsor. Failure to respond within the applicable time period will result in forfeiture of prize and Sponsor shall have the option to award the prize to an alternate winner. The return of any prize notification or prize as undeliverable may result in disqualification and an alternate winner may be selected. All income taxes resulting from acceptance of prize are the responsibility of winner. By entering this contest, entrant accepts and agrees to these Official Rules and the decisions of the Sponsor, which shall be final in all matters. Acceptance of a prize also constitutes permission to the Promotion Parties to use winner's name and likeness for marketing purposes without further compensation or right of approval, unless prohibited by law. All Hong Kong SAR, US federal and state laws apply.
5. LIMITATION OF LIABILITY: By entering this giveaway, entrants waive all right to, and hold the Promotion Parties harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) arising out of or in connection with participation in this giveaway or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Promotion Parties will not be responsible for: late, incomplete, or incorrect entries; an entrant's failure to receive prize notices due to entrant's spam, junk e-mail, or other security settings or for entrants' provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this giveaway; by any human error which may occur in the processing of the entries in this giveaway; or any typographical, technological, or other error in the publishing of the offer, administration of the giveaway, or announcement of the prize[s]. If, in the Administrator's opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the giveaway, or if technical difficulties (including viruses and bugs) compromise the integrity of the giveaway, Sponsor reserves the right to request that the Administrator, in its sole discretion, cancel or modify this giveaway in a manner deemed appropriate by the Administrator. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form.
6. PRIZE[S]: There will be a total of FOUR (4) winners; EACH of the confirmed giveaway winners will receive the following prizes: an Art Basel One-Day VIP ticket (allows one-day access of the Art Basel for two persons between 23-25 March, 2023). ADDITIONAL PRIZE: EACH of the confirmed giveaway winners will be eligible for a one-way 30-minute yacht experience for two from Rosewood Hong Kong to The Hong Kong Convention and Exhibition Centre (advance reservation is required) if the giveaway post reaches 1,500 likes. The winners may be asked to present his or her photo ID to confirm their identities upon prize redemption. No substitution or transfer of prize is permitted by the winners. Sponsor reserves the right to substitute a prize of equal or greater value. All prizes will be awarded and must be redeemed by 24 March, 2023. If a potential winner is disqualified for any reason, Sponsor will award the applicable prize to another winner by applying the same judging criteria to all remaining eligible entries. Only FOUR (4) alternate re-selections will be held in total, after which the prize will remain un-awarded.
- CHOICE OF LAW AND FORUM: Entrant agrees that all matters arising out of or relating to this Giveaway and these Official Rules are governed by, and construed in accordance with, the laws of Hong Kong SAR, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this giveaway and these Official Rules shall be brought exclusively in the applicable courts located in Hong Kong SAR.
